Let me tell you a little bit about myself. I am a cowboy or redneck and the guys here call me Hillbilly! J I was born in Dallas, Texas. Birth date October 6th 1964. I am six foot one inch tall (6’1”) and weigh 210 pounds. I have a medium build, brown hair and green eyes.

I enjoy motorcycle riding, country western dancing, boating, and cooking. Especially cooking on an out door grill. I also enjoy reading books and writing letters. I have a very good sense of humor and love to make people smile and laugh.

I have no family support to help me through this situation I am in! This makes it very hard and difficult to write at times but I promise to do my very best and write in return as soon as I can.

I would like a pen pal with a good sense of humor and someone who will write honestly and really enjoy getting to know me. I seek a person who can keep an open mind about my situation here.

I will write with the utmost respect and ask the same in return. This is a very difficult time and can be very stressful at times and I need letters to pull me away from my confinement and into another world. A world of freedom!

Cary D. Kerr, was convicted in April of 2003 of Capital Murder and was sentenced to DEATH by lethal injection! Mr Kerr, is 100 % innocent and is fighting for his life and his right to live!

The case of Cary D. Kerr, is 100 % circumstancial and actually shows no evidence at all that Mr Kerr committed any crime at all!!

Mr Kerr was convicted because of POOR Court Appointed attorneys and a over zealous prosecutor ! The prosecutor in Mr Kerr's case LIED, MISLEAD and told a jury to DISREGARD D.N.A. evidence that EXCLUDED Mr Kerr!!!!

The victim in this case was a friend of Mr Kerr's and it was known that they hung on together from time to time, they were even neighbors for around 5-1/2 months. Police stated that since Mr Kerr was out with the victim earlier the night she was murdered that that was good enough for them ! Police NEVER investigated any other potential suspects but sought Mr Kerr only!

The lead detective in Mr Kerr's case stated that he should have done a full investigation during trial.

There is an abundant amount of evidence that shows Mr Kerr's innocence and this evidence is in the Trial Transcripts. This evidence is listed as follows:

1. There is two forms of D.N.A. evidence that Excluded Mr Kerr.
   a. Semen found in the victims vagina did not match to Mr Kerr
   b. Skin cells found on the victims torn brassiere did not match to Mr Kerr and did not match to the victim.
    
2. The victim was run over by a vehicle and a tire print was found on the leg. This print did not match to any of Mr Kerr's tires. There was also no evidence of blood or skin found on Mr Kerr's vehicle that police said was the vehicle that ran over the victim.
    
3. Medical Examiner stated that the victim fought her attacker back but then went on to say he don't remember what happened to the victim's finger nails clippings. This is lost D.N.A. ?? That would show Mr Kerr's innocence.
    
4. The victim was beat very bloody and had 26 cuts on her head and upper body. The prosecutor stated the victim was beat with a bloody club.
   During the investigation police NEVER FOUND any blood or tissue in Mr Kerr's vehicle, NEVER FOUND any blood or tissue on Mr Kerr himself ! There was no signs of violence at Mr Kerr's home on or his body. There was no weapons of any kind found anywhere.
    
5. The Lead Detective in this case has a history of TAMPERING WITH EVIDENCE and it is on record. This detective testified to going out to Mr Kerr's home after Mr Kerr was arrested. This detective stated he went out to Mr Kerr's home WITHOUT a warrant and WITHOUT Mr Kerr's permission ! Even stated that the door was unlocked but he did not enter ???? Right !
    
6. There was a blonde hair that a police officer stated that he removed from Mr Kerr's person and the D.N.A. Expert could NOT get this hair to match to the victim.
    
7. An eyewitness stated he seen a white male driving a white Land Rover stop at the crime scene and get out of his vehicle. This white male had a tattoo on his left shoulder and was 5' 9" or 5' 10" tall. Mr Kerr is 6' 1-1/2" tall and does NOT have any tatoo's on either shoulder. During trial the same eyewitness changed the color of the Land Rover but stated "FOR SURE IT WAS A LAND ROVER". Mr Kerr does NOT own a Land Rover nor was he driving one !
8. 
   Police let a dark colored vehicle leave the crime scene that was parked close to the body when police arrived. The Emergency Technician (EMT) pointed the vehicle out to police but the police chose to ignore it and let it leave without even checking the driver out !

Mr Kerr's Attorneys were court appointed and did very little to help Mr Kerr. In fact one of Mr Kerr's Attorneys told jurors several times that "they did not really have to do anything but show up" "That it is up to the State to prove Mr Kerr broke the law". Mr Kerr's Attorneys let the State to do whatever they wanted to and say anything they liked.

The State (PROSECUTION) told a jury to disregard DNA evidence that excluded Mr Kerr. They were told not to even think about it ! The Prosecution further stated that Mr Kerr was a serial rapist ! That he has prayed on women for a long period of time !! Mr Kerr has NEVER been convicted of any rape ! He has no history of violence and never been convicted of any felonies' !

This was serious misconduct by the prosecution ! The prosecution is also re-indicted Mr Kerr 60 days before trial adding robbery to the indictment and at the very end of Trial, the prosecution dismissed the robbery element of the indictment !! Mr Kerr was accused of taking a wallet (day planner) from the victim. There was a young woman that sat through the entire trial and listened to people testify about this missing day planner, she was a friend of the victim and sat with the victim's family. This young woman had the day planner the entire time !!! She had the day planner for 23 months ! This was a play by the prosecution to make Mr Kerr look bad. The prosecution knew they had a very weak case so they mislead the jury with the robbery element and the bloody club ! The prosecution tried to hide the DNA evidence.

Mr Kerr has a Court appointed Habeas Corpus Attorney that will not even respond to his letters ! This attorney did not even file all the issues in Mr Kerr's case and has left out the DNA issues as well!

Mr Kerr's attorney filed very few of the issues stated in this letter ! he has even been reported to the State Bar several times and has a Private Investigator do a story on him in News Week Magazine back in year 2000 about the very poor work that he does on his clients cases!

Mr Kerr is seeking people that will get involved in his case. He is seeking pen friends to correspond with. He is seeking legal help or any other help that is offered. Please contact Mr Kerr for more info.
